Summary Criminal Charges
Charged With a Summary Offence? Don't Plead Before You Call Us.
A summary conviction under the Criminal Code of Canada still goes on your record — and can affect your job, travel, and immigration status. We build a defence before you do anything you can't undo.
Important: Paralegals in Ontario are authorised to represent you on summary conviction matters only (Criminal Code offences carrying a maximum of 2 years less a day). For indictable or hybrid offences proceeding by indictment, we refer you to a trusted criminal defence lawyer — free of charge.
What Is a Summary Conviction?
The "Less Serious" Criminal Charges — Still Serious to You.
The Criminal Code of Canada divides offences into three categories: summary, indictable, and hybrid. Summary offences are the least serious — but "least serious" in Criminal Code terms can still mean:
- A criminal record
- A fine of up to $5,000
- Up to 2 years less a day in jail (for certain offences)
- Travel restrictions — particularly to the U.S.
- Immigration consequences for non-citizens
- Employment and volunteering restrictions (vulnerable sector checks)

| Mischief under $5,000 — s. 430 | Property damage charges — wide variety of outcomes possible. |
| Causing a disturbance — s. 175 | Often overcharged by police. Strong defences available. |
| Trespass at night — s. 177 | Specific intent required — strong defence angle. |
| Failure to comply (summary) | Bail/probation breach matters when prosecuted summarily. |
If your charge is indictable or the Crown elects to proceed by indictment, we hand your file to a lawyer we trust. Our advice is free regardless.
How We Defend You

Criminal Summary FAQ
The Answers That Matter Most Right Now.
Only if you're convicted. A withdrawal, stay, or peace bond does not create a conviction. Even a conviction can later be pardoned (record suspension).
Don't miss it. Call us before that date. Skipping court creates a fresh offence (failure to appear).
Pending charges and certain convictions can create problems at the border. We'll walk you through the risk.
Non-citizens: criminal charges can affect status and sponsorship. Tell us your status at the consultation — this changes strategy.
Possibly. Legal Aid Ontario has income thresholds. If you qualify, we'll tell you.
